Acceptable Use Policy

The present Acceptable Use Policy (AUP) applies to all customers that have their websites hosted on servers at Domínios.PT (Shared Hosting, Dedicated Servers, Virtual Private Servers and Housing services).

Domínios.PT is a registered trademark of Flesk Telecom Lda., one of the most prevalent companies in the Portuguese market operating in the area of domain registration, website hosting and server housing.

Flesk Telecom Ltd is a Portuguese company that fully appreciates the quality of its services proven throughout his nearly 10 years of activity.

The Acceptable Use Policy defined by Flesk Telecom Lda. is intended to protect their systems and services to ensure that the availability of both leads to total customer satisfaction, as a result of increased security for the customer.

  1. Security of Networks and Systems

    1. Users are not allowed to actual or attempted break-in of any system that composes the infrastructure of Flesk Telecom Lda., including its security systems. The following type of actions are not permitted:

      1. Unauthorized entry or attempted entry into a server;
      2. Use of cracking, brute-force or dictionary attacks for unauthorized access;
      3. Automatic detection of services on servers (Port scan);
      4. Non-authorized search of vulnerabilities in servers, networks and services.

    2. It is strictly forbidden to falsify data in order to deceive or mislead recipients of data, which include but are not limited to:

      1. Tampering of IP addresses (IP Spoofing);
      2. Tampering of ARP addresses (ARP Spoofing);
      3. Tampering of headers in email messages.

    3. It's not allowed to intentionally interfere in the smooth running of servers, services or networks. These cases include:

      1. Overload of systems and/or networks, which intend to disturb the normal operation of services (Denial of Service);
      2. Sending bulk packages (Flooding);
      3. Any attempt to block or disrupt services, servers or networks.

  2. Contents

    Users of our hosting services are the only responsible for the contents hosted at our servers, so they should manage the data correctly guaranteeing the respect for the following rules:

    1. Unlawful use of copyrighted content;
    2. Contents of pedophiliac nature;
    3. Contents that incite criminal acts;
    4. Contents that would incite violence;
    5. Illegal contents;
    6. Offensive or discriminatory content based on religion, sex or race;
    7. Content that trick users into think that it is other website (Phishing);
    8. Viruses, Trojans, Malware or any other malicious software to users who visit these websites;
    9. Sharing or exchange of software or information protected by copyright;
    10. Software enabling the use of servers as ”Open Relay“ or ”Open Proxy“;
    11. Software without proper licensing;
    12. Outdated software with known bugs or exploits that lead to hostile control of the server;
    13. The installation of proxies or NAT;
    14. The installation of anonymizers.

  3. Shared Hosting

    2.2 Being a service shared by several users, it's not allowed any CPU, Disk or Memory usage that can interfere in the smooth running of the servers and services to other users.

    The Hosting and Housing services expressly disallow:

    1. The use of CPU above 25% for more than 90 seconds;
    2. The use of more than 100.000 files at the hosting account;
    3. The use of shared hosting as backup service;
    4. The use of the hosting service for files exchange;
    5. Creating Cron Jobs with breaks lower than 15 minutes;
    6. The installation of peer-to-peer software;
    7. The use of Web Spiders or indexers.

  4. Email and Anti-Spam Policy

    The abusive use of e-mail causes inconvenience and damages the infrastructure of Flesk Telecom Lda., ad well as other users and third parties, directly and indirectly, as it undermines the normal functioning of systems and service support.

    Flesk considers SPAM all and every email sent with commercial purposes and unsolicited by the recipient. In addition, all email that can damage the infrastructure of Flesk Telecom Lda. or index our IP addresses at black lists will also be considered SPAM.

    As such it is not allowed:

    1. Sending SPAM;
    2. Sending bulk unsolicited commercial or personal emails;
    3. Sending emails to those who have explicitly requested its cancellation;
    4. Use of our servers as SMTP ”open proxy“ or ”Open Relay“;
    5. Hosting of pages that provide SPAM services;
    6. Hosting of pages advertised by spam sent from other networks (”spamvertising“).
    7. Any action that indexes Flesk at black lists.

  5. IP Assignment

    Flesk Telecom Lda. has its own range of IP addresses that assigns to each server. You may not:

    1. Use IP's other than those allocated;
    2. Use IP's from other servers.

  6. Interventions of Flesk Telecom Lda.

    Whenever abusive acts are detected and the intervention of Flesk Telecom Lda. is required to solve these situations, it may, without any prior consultation with the customer, either:

    1. Notify the customer by email or phone, giving it a period of 24 hours to stop the abuse or violation of the current AUP;
    2. Make the necessary intervention for immediate resolution of the problem, with the customer being charged the technical intervention based on the current hourly rates announced on our site.
    3. Immediately suspend the service, without any prior warning, if the gravity of the situation justifies.

  7. General considerations

    1. Flesk Telecom Lda. reserves the right to definitely cancel or temporally suspend any hosting service (Shared hosting, Dedicated Servers, VPS, and Housing) without ant right to reimbursements if this AUP is violated.;
    2. Flesk Telecom Lda. reserves the right to suspend any service if it causes any type of damages at our infrastructure or to the services provided to the other clients;
    3. Flesk Telecom Lda. reserves the right to review it's politics and this AUP, at any moment without previous notice, being the new AUP version available at our website.
    4. Flesk Telecom Lda. can't be held responsible for any losses caused by the suspension of the services if this AUP is violated.
