Conditions for the Provision of Service Accommodation

These general conditions are intended to establish the terms and conditions by which it will govern Domínios.PT in providing the housing service to its customers.

The hosting service includes accommodation on the Internet and the provision of additional services subscribed by the client.

Entities involved in the subscription of the hosting service:

Domínios.PT - Entity that provides the hosting (Shared Hosting, Dedicated Servers, VPS and Housing).

Client - One who subscribes the hosting (Shared Hosting, Dedicated Servers, VPS and Housing) under payment.

Restrictions and requirements for hosting sites

  1. The Rules and Restrictions regarding web hosting are available at the Acceptable Usage Policy (AUP) defined by Domínios.PT that can be consulted at http://www.dominios.pt/hosting/pua.aspx.
  2. Domínios.PT reserves the right to remove sites that violate their Acceptable Use Policy, promote illegal activities and / or which may be harmful to servers Domínios.PT or any other server on the Internet. There are also banned sites that link to such sites.
  3. All of the above violations may result in immediate suspension of the hosting service without notice or refund. There may also be compensation to Domínios.PT for any damage caused.

Web Hosting functioning

  1. Domínios.PT allows the client to create a personal identification code (user name) and a password to access the the hosting services.
  2. The identification codes and passwords are personal and in-transmissible . The client must assure and protect at any circumstances the confidentiality of that information not reveling it to any third persons and not allowing it to be decoded, copied or abusive used.
  3. Domínios.PT won't be responsible for any losses or damages caused by abusive use of user names and passwords.
  4. The client compromises to identify himself when accessing the services with the login and password created and compromises to never use the login information created by other client.
  5. The client compromises not to use the hosting service for illegal proposes as divulging information that attempt against the moral integrity or any rights or interests of other persons. The client compromises as well not to propagate information that can be qualified as an action and/or incitement to criminal/illegal activities or any other information that can be consider contrary to the law.
  6. Domínios.PT won't assume any responsibility on damages caused by external and unpredictable factors that can't be controlled.
  7. Domínios.PT can't guarantee that the shared hosting service is interrupt and can't be responsible for the inability to use the service.
  8. Domínios.PT guarantees a 99,95% SLA for dedicated hosting service (Dedicated Servers, VPS, Housing – SLA available at http://www.dominios.pt/dedicated/sla.aspx
  9. Domínios.PT reserves the right to suspend the hosting service in cases of incorrect fulfillment of the obligations above. Domínios.PT won't be responsible for the inability to use the service in cases of suspended accounts if the client violates the rules and restrictions defined at AUP.
  10. Besides the above conditions as well as the rules present in our AUP that can lead to accounts suspensions, a hosting account can only be suspended for 2 other reasons: lack of payment for 2 or more months or if requested by the client.
  11. The request to suspend a hosting account must be written by the client and sent by email, regular mail or fax.

Pricing, Payments and Billing

  1. The client is entitled to require the suspension of the hosting service (Shared hosting, Dedicated servers, VPS and Housing) and to request the refund of the amount payed if requested at the first 14 days counting from the day when the service is activated.
  2. When the hosting service includes an activation fee and the suspension of the account is requested in the first 14 days, the client have the right to request the refund of the amount payed excluding the activation fee, whether it was charged or not.
  3. When a client decides to suspend the hosting account after the first 14 days counting from the day when the service was activated, it won't be possible to refund the amounts payed, even the payment regarding the period that wasn't used.
  4. The prices regarding the hosting service charged by Domínios.PT are available at our pricing list. Domínios.PT reserves the right to change the pricing list at any moment.
  5. All payments must be done previously to the billing period in question. All documents regarding the payments made will be sent by mail. Excepting some specific situations Domínios.PT won't send receipts previous to the payment.
  6. Domínios.PT won't be responsible for any losses resulting on the suspension of the hosting services due to lack of payment or a client request for suspention.
  7. Regarding Reseller and Housing accounts suspended due to lack of payment, Domínios.PT reserves the right to move the domain (website and email service) away from the current server in order to be managed directly by Domínios.PT, if requested by the client.
  8. By subscribing a hosting account and proceed with the first payment we will assume that the client had read and accept this Terms & Conditions.
